Whatever, have you ever been hit by a paintball at 200 fps. It will leave a bruise 1.25" in diameter and a welt 3/8 of an inch high. This is the same speed of an arrow from a low pound bow. It is lethal! Ask any deer! These THUGS are running their bubble guns between 400 and 600 fps. At this velocity, if a person was hit in a eye or on the temple, would more than likely result in death. Why are they running these control guns at 3, 4 times their effective speed?. At 200 fps it will render you blind. Just ask a young girl here in my hometown. Randy talks about taking this to the FBI. The agent knows that you don't have to but once you file, you've been had. See Title 26 U.S.C § 6331. Levy and distraint (a) Authority of Secretary If any person liable to pay any tax neglects or refuses to pay the same within 10 days after notice and demand, it shall be lawful for the Secretary to collect such tax (and such further sum as shall be sufficient to cover the expenses of the levy) by levy upon all property and rights to property (except such property as is exempt under section 6334) belonging to such person or on which there is a lien provided in this chapter for the payment of such tax. Levy may be made upon the accrued salary or wages of any officer, employee, or elected official, of the United States, the District of Columbia, or any agency or instrumentality of the United States or the District of Columbia, by serving a notice of levy on the employer (as defined in section 3401(d)) of such officer, employee, or elected official. 1st hour: Topic if discussion: IRS buggaboos, States rights and Federal Jurisdiction.Thier very mis-use of power is thier weakness. Randy talks about the Agent strategy in PA. The state has the ability to prosecute federal agents in criminal action. If the federal agent doesn't show you where they got the authority to come into the state, it is reasonable to consider that he does not have the authority. Once jurisdiction has been questioned it has to be proven. If he doesn't have and he is trying to act as thou he does in the state, he is a criminal. When we file against the agent, we are trying to create a political solution. File with the DA, he will trash it, then we file with the AG against the agent and the DA. He is going to trash it also. Then we go back to the DA and file against the AG for obstruction of justice. Then we go to the court of common pleas and petition the court to prosecute the DA and the AG. The judge isn't going to act. Then we file against the judge of common pleas. Randy goes on to lay out the political strategy and the larger picture and how to get people involved. Randy talks about JURISDICTION, Great Explaination. If the agent had no jurisdiction, the federal judge can not derive jurisdiction from the agent. Now we can go after the federal judge. LISTEN UP .
2nd hour: Wendy Calls In. Its a lot of fun to listen how she is kicking them around. Kenny from CA: Juris Dictionary package, wrote his first request for production. Got to section on NO Complaint of Randy's Writ of Habeas Corpus. Kenny asks several good questions, such as exspongment, 3rd part complaints, no complaint in the court record. Russell from TX calls in asking about getting the names of the Grand Jury members names. Do an OPEN RECORDS at the Clerk. Guest: Ben Drum from Dallas County, Texas. Ben jumps around on the code. It makes sence to me, so look thes up and cross reference them within your state. TX code 51.901 902 & 903 here is a motion for you to file against a LIEN. Next 28 USC 3201(a) creation of a judgement lien. Try going to the clerk and ask for certified copies of the judgements. Title 26 6321, 6322 & 6323. 26 CFR 301.6203-1 Method of Assesment (the activity your are involved in). If you do a FOIA on your activity they will send you a RAKS 006. Jumps back to 6322 and 6223. 6322 says it is the assessment that makes tou liable. 6323(f) says that this has to be done in accordance to state law for filing a lien. And in the state there has to be an abstract of judgement, look at TX property code 52, you have to attach an abstract of judgement. Here is the form that the DOJ requires to be used in the filing of and abstract of justice 28 USC 3201, THEY DON"T USE IT. KENNY, off topic but asked about a writ of mandamus.

Terms to know:

DE FACTO: In fact, not according to law.
DE JURE: Complying with the law in all respects.
Pro Se:

Ex Parte:

Writ of habeas corpus

Guidelines for filling out a Complaint.

State the facts clearly.

When you fill a criminal complaint, you can not be sued. Provided that you stated the fact truthfully 20070615_Fri_Kelton2.mp3

What gets a 911 call?

For example, you have filed a complaint against and officer and other officer says, " well you know it’s a crime to put a false statement on a government document" thinking that he is doing a good thing. Does that office carry a BARR card? If he does not have one then he is offering legal advise and he can’t do that. Remember you are the aggrieved, you have every right to file a complaint, and you are doing your civic duty. 20070615_Fri_Kelton2.mp3

Check the statutes in your state: Randy went to file a writ of habeas corpus. Clerk said that there use a filing fee of 200.00. Randy pulled out his cell phone and call 911. Randy did not debate, didn’t tell him what the law was etc. This public servant should already know the laws pertaining to his job. A filing fee for a writ of habeas corpus is prohibited. 20070615_Fri_Kelton2.mp3

Boundaries for:

Court:

The court loses jurisdiction by: who ever filed the complaint, the process getting you from the original complaint to the court if any laws were violated during the process then court loses jurisdiction. Writ of habeas corpus 20070615_Fri_Kelton2.mp3

Let me say this another way: If part of the prosecution team including the police department from the point of the filing of the complaint until the time you get to the court, if they violated laws, by their violation of law they denied the court jurisdiction. Listen up, not the judge but the court itself. 20070615_Fri_Kelton2.mp3

Denial

Judge(s):

If a Judge commits a criminal act, the judge stops being a judge (read the code) and becomes a criminal perpetuator and the judge himself has no jurisdiction to act however the court does not lose its jurisdiction by the acts of an individual. 20070615_Fri_Kelton2.mp3

District Judge(s)

Prosecuting Attorney(s)

US Marshals

Highway Patrol

Sheriff Department

Police Department

Important things to know

Jurisdiction, Don’t ever ignore the courts, even if they don’t have jurisdiction they think that they have or present themselves as having jurisdiction. If you don’t challenge it they will assume that they have jurisdiction. 20070615_Fri_Kelton2.mp3

Any time a public official violates a law related to their office, that costs them jurisdiction. First thing to do is move to disqualify. 18 USC 242. Every state has a law that reflects the same position. 20070615_Fri_Kelton2.mp3

Do’s and Don’ts

Don’t go to the Police department and complain. That is complaining. They will give you a voluntary statement to fill out. That statement is not even worthy of being used a toilet paper. 20070615_Fri_Kelton2.mp3

Do, Go down to the clerk and ask to see the last five criminal cases filed in the court. Look at the criminal complaint or information. Information is generally what the prosecutor gives to the court. That is the just of a criminal complaint. The prosecutor files an information. Citizens file a complaint(s) so if you file a complaint. The court will then tell the prosecuting attorney to take the complaint and convert it into an information. What you have now is an information that meets all of the requirements of law. If you swap out "information" with "complaint" you will have what you need in format for a complaint in your state. 20070615_Fri_Kelton2.mp3

To protect your rights: read the Penal Code and Code of Criminal Procedure. Then read it a second time. Now you will begin to recognize when public officials violate a law or your rights. 20070615_Fri_Kelton2.mp3

Things to say:

When a judge says something like "denial of counsel": Well I can do that

Well okay, lets see what a grand jury will say about you doing that. I don’t care what you say because you are interested in your position and what is important to you. The grand jury does not have the same interest. Their interest is in rule of law. So if you are right then you have nothing to worry about judge so we go ahead and see what the grand jury has to say about it. 20070615_Fri_Kelton2.mp3

Strategies

Ask yourself: How will this play in front of a grand jury of my peers?

Don’t get angry, only act angry.

Try not to turn these officials into demons, think of them as children that needs a spanking.

Teach them on the minor issues first.

Ask yourself, what do I want to achieve? If you don’t know, don’t do anything until to you know.

You know the saying " You can’t teach an old dog new tricks" well "Randy Kelton can make lying dogs stay in the yard"
